What changed
Regulation (EU) 2026/1744 entered into force on 27 July 2026 with five dated effects on the AI Act: Annex III high-risk obligations move from 2 August 2026 to 2 December 2027; Annex I embedded high-risk from 2 August 2027 to 2 August 2028; Article 50(2) machine-readable marking gets a transition to 2 December 2026 for generative systems already on the market before 2 August 2026; two new prohibited practices under Article 5(1)(ba) and (bb) apply from 2 December 2026; and Article 4 on AI literacy was replaced without its date changing.
Why it matters
Two of the five changes are easy to get wrong. The Annex I embedded high-risk track moved from 2 August 2027 to 2 August 2028 — it never shared the 2 August 2026 date that the Annex III track had. And the AI literacy duty kept its date while its substance changed: the replaced Article 4 states expressly that it does not require guaranteeing any specific level of AI literacy. A timeline that only tracks dates misses that one entirely.

- Confirm which high-risk track your systems fall in: Annex III (2 December 2027) or Annex I embedded (2 August 2028) — the two moved from different starting points
- If you place generative AI on the market, check whether your systems were on the market before 2 August 2026; only those get the Article 50(2) transition to 2 December 2026
- Re-read the replaced Article 4 if your AI literacy programme was scoped against the original wording
- Note the two new Article 5 prohibitions applying from 2 December 2026 — these did not exist in the AI Act as adopted
